:Take-Two liked to publish games through their subsidiary companies, and GoD was one of them. Note the footnote on GoD in the article: when GoD was shut down, it was merged into one subsidiary which was later merged into another, so the publishing rights for Oni are probably with them now. In any case, T2 owns the IP for Oni, so they can do with it what they like. For instance, see the link behind "June 16, 2000" which shows the trademark being assigned to T2. Take-2 Interactive List
It's strange, but I've found no information about Oni in the list of all games, that published (and/or developed) by T2. Here is the list. Only in this list there is a row about Oni, but this is a list of games of GoD (which is officially defunct). So, maybe T2 has no rights for Oni already?
